1. Acceptance of Terms

By accessing or using WorkWorks (the "App"), a product of Prodaigy ("we", "us", "our", or "Company"), you ("User", "you", or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not access or use the App. Your continued use of the App constitutes your acceptance of these Terms and any future modifications.

You must be at least 18 years of age and have the legal capacity to enter into a binding agreement to use WorkWorks. By using the App, you represent and warrant that you meet these requirements and that you are not barred from using the services under the laws of any applicable jurisdiction.

To access certain features, you must create an account and provide accurate, current, and complete information ("Athlete Data"), including your name, email address, and fitness-related details. You agree to:

Prodaigy reserves the right to suspend or terminate accounts that contain inaccurate, misleading, or fraudulent information.

5. Corporate/Entity Use

If you are using WorkWorks on behalf of an organisation, company, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms. In such cases, "you" and "your" refer to both you individually and the entity you represent.

6. Subscription & Payment Terms

6.1 Plans

WorkWorks offers the following subscription plans:

6.2 Free Trial

New subscribers may be eligible for a 7-day free trial. Unless you cancel before the trial period ends, your subscription will automatically convert to a paid subscription at the applicable rate.

6.3 Auto-Renewal

All subscriptions automatically renew until cancelled. You will be billed at the start of each renewal period (monthly or annually, as applicable).

6.4 Billing

Billing is handled through the Apple App Store, Google Play Store, or RevenueCat. Payment processing, receipts, and billing inquiries are managed by the respective platform.

6.5 Cancellation

Cancellations must be made through the subscription settings of your respective app store (Apple App Store or Google Play Store). Cancelling your subscription will stop future billing but does not entitle you to a refund of the current billing period.

6.6 Fee Changes

We may change subscription fees with reasonable advance notice. Continued use of the App after a fee change constitutes acceptance of the new pricing.

7. Refund Policy

All subscription fees are non-refundable except as required by applicable law. For purchases made through the Apple App Store or Google Play Store, refund requests must be submitted through the respective store's refund process. Prodaigy does not directly process refunds for app store purchases.

8. Payment Methods & Authorisation

You may pay for subscriptions via credit card, debit card, Apple App Store, Google Play Store, or other third-party payment providers as made available. By providing payment information, you authorise us and our payment processors to store and encrypt your payment details and charge the applicable fees. All payment information is handled in accordance with industry-standard security practices.

9. EU Consumer Withdrawal Rights

If you are a consumer in the European Union or European Economic Area, you have the right to withdraw from a digital content purchase within 14 days of the transaction, provided the digital content has not yet been accessed or downloaded. By accessing WorkWorks immediately upon purchase, you acknowledge and consent to the waiver of this 14-day withdrawal right, as permitted under Directive 2011/83/EU.

10. Data Processing

Processing of your personal data is required for service delivery and is conducted in accordance with our Privacy Policy. By using WorkWorks, you acknowledge and agree that your data will be processed as described therein.

WorkWorks uses artificial intelligence and machine learning technologies to provide workout recommendations, progressive overload calculations, 1RM predictions, and AI Coach responses. You acknowledge that:

12. Intellectual Property

All content within WorkWorks, including but not limited to the app design, branding, logos, exercise database, workout algorithms, AI-generated content, text, graphics, and software, is the exclusive property of Prodaigy or its licensors and is protected by applicable intellectual property laws. All rights are reserved. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes in accordance with these Terms.

You agree to use WorkWorks only for lawful purposes and in compliance with these Terms. You shall not:

You acknowledge that physical activity involves inherent risks, and you assume full responsibility for your exercise activities. 15. Disclaimer of Warranties

THE APP AND ALL CONTENT, FEATURES, AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PRODAIGY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE MAKE NO GUARANTEES REGARDING FITNESS RESULTS, WEIGHT LOSS, STRENGTH GAINS, OR ANY OTHER OUTCOMES.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PRODAIGY, ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP.

IN NO EVENT SHALL PRODAIGY'S TOTAL AGGREGATE LIABILITY TO YOU EXCEED THE AMOUNT OF SUBSCRIPTION FEES PAID BY YOU TO PRODAIGY IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

17. Indemnification

You agree to indemnify, defend, and hold harmless Prodaigy, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use or misuse of the App; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) any third-party claims arising from your use of the App.

18. Termination & Suspension

18.1 By You

You may terminate your account at any time by cancelling your subscription through your app store settings and ceasing to use the App.

18.2 By Prodaigy

We may suspend or terminate your access to the App at any time, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or for any other reason at our sole discretion.

18.3 Effect of Termination

Upon termination, your right to access and use the App ceases immediately. We may retain your data for a period of 30 days following account deletion, after which it will be permanently removed, except where retention is required by law. Sections that by their nature should survive termination (including Intellectual Property, Disclaimer of Warranties, Limitation of Liability, and Indemnification) will survive.

If you downloaded WorkWorks from the Apple App Store or Google Play Store, the following additional terms apply:

20. Dispute Resolution & Governing Law

Any disputes arising out of or relating to these Terms or your use of WorkWorks shall be resolved through binding arbitration, where permitted by applicable law, administered in accordance with the rules of a recognised arbitration body. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against Prodaigy. The venue for any legal proceedings shall be determined by Prodaigy's principal place of business, unless otherwise required by applicable consumer protection law.

Nothing in this section limits your rights under mandatory consumer protection laws in your jurisdiction.

21. Modifications to Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised effective date. For material changes, we will provide notice via email or in-app notification. Your continued use of WorkWorks after such modifications constitutes your acceptance of the updated Terms. If you do not agree with the changes, you must stop using the App and cancel your subscription.

22. Severability, Entire Agreement & Waiver

Severability: If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

Entire Agreement: These Terms, together with the Privacy Policy and Health Disclaimer, constitute the entire agreement between you and Prodaigy regarding the use of WorkWorks, superseding all prior agreements and understandings.

Waiver: The failure of Prodaigy to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

23. Language

These Terms are drafted in English. In the event of any conflict between the English version and any translation, the English version shall prevail and control.
